Terms of Service
Effective date: January 1, 2025
1. Acceptance
By accessing or using the Own the Works website or platform, you agree to these Terms. If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that business.
2. Description of service
Own the Works provides a field-service management platform for home-services businesses, including website, booking, invoicing, dispatch, review management, and AI-assisted customer communication tools. The platform is sold as a one-time build engagement; ongoing hosting and third-party API costs are the customer's responsibility.
3. One-time price and ownership
Upon full payment, you receive a perpetual, irrevocable license to use, modify, and distribute the delivered code. Own the Works retains no ongoing rights to the delivered codebase. The 90-day bug fix guarantee described in your project agreement is a separate contractual obligation, not a condition of the license.
4. Acceptable use
You agree not to use the platform to:
- Violate any applicable law or regulation
- Send unsolicited commercial messages without proper consent
- Impersonate any person or entity
- Interfere with the security or integrity of the platform
- Resell access to the platform to third parties without a separate agreement
5. Intellectual property
The Own the Works name, logo, and marketing materials are the property of Own the Works, Inc.. The delivered project code is licensed to you as described in Section 3. Open-source components are governed by their respective licenses (MIT, Apache 2.0, etc.), which are included in the delivered codebase.
6. Disclaimer of warranties
THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWN THE WORKS, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWN THE WORKS, INC.'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Collin County, Texas.
9. Changes
We may update these Terms. Material changes will be posted with 14 days' notice. Continued use after the effective date constitutes acceptance.
